Biden: Desperation at the Door -EO Monday – Chilling in the South

Legal Scholars will have their hands full:  As a final insult to America on his way out the door, Biden pardons Fauci, Milley, and members of the Jan. 6 committee | AP News.  We aren’t sure this is legal because crimes have not been charged.  So we put the question to A.I.

Yes, a president in the United States can preemptively pardon an individual for crimes they may have committed, even if they have not yet been charged or convicted. This is based on the broad pardon power granted to the president under Article II, Section 2 of the U.S. Constitution.

Historical Example:
President Gerald Ford pardoning Richard Nixon: President Ford issued a full and unconditional pardon to Nixon in 1974 for any crimes he “committed or may have committed” during his presidency. Nixon had not been formally charged with any crime at the time of the pardon.

Limitations and Scope:
Federal Crimes Only: A presidential pardon only applies to federal offenses, not state or local crimes.
Impeachment Exception: The president cannot use the pardon power to stop impeachment proceedings or remove the consequences of impeachment.
Specific or Broad: The pardon can be narrowly tailored to specific offenses or broadly cover any crimes the individual might have committed during a specified time frame.

Two ways to read this latest affront from Biden:  One is that it’s tantamount to admitting that those named did, indeed commit crimes; just they haven’t been caught up with  yet.  The other is that it’s a “pure intent” to do the right thing.  (Sorry, color us skeptical!)

Is a pardon bulletproof?  yes, but there are limits:

“Fraud or illegality: In rare cases, if a pardon was obtained through fraud or unlawful conduct, it might be subject to legal challenge. For example, if the recipient concealed material facts during the application process or bribed officials, a court could potentially invalidate the pardon.”

Whether “material facts” were concealed? In the case of COVID, for example?  Um…

Meanwhile, “Fox News reports Trump will sign an executive order tomorrow suspending the security clearances for the 51 ex-intel officials who signed onto the bullshit Hunter Biden laptop letter in an effort to help Biden win. A totally justified & long overdue move…X

Markets and Moments

Global markets were doing well overnight, but this was expected.  Because at the Friday  close, the U.S. markets were higher than our Global Aggregate and averages globally tend to run parallel.  After a nice sharp 3-wave move down (shades of Elliott wave functions) Bitcoin was up to $108,000 and holding fairly steady at press time.

We found it interesting that Trump Became a Crypto Billionaire Overnight Thanks to ‘Trump Meme’ Coin. While in a related development, we have serious misgivings about having a president who has turned into an alt-money advocate.  Last time we checked, he was supposed to be loyal to “protect and defend the Constitution.”  to amplify our concerns, we have:

Article I, Section 8, Clause 5:

[The Congress shall have Power . . . ] To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures; . . .

Because Article I, Section 10, Clause 1 of the Constitution prohibits the states from coining money,1 the Supreme Court has recognized Congress’s coinage power to be exclusive.2 The Supreme Court has also construed Congress’s power to coin money and regulate the value thereof to authorize Congress to regulate every phase of currency. Congress may charter banks and endow them with the right to issue circulating notes,3 and it may restrain the circulation of notes not issued under its own authority.4 To this end, it may impose a prohibitive tax upon the circulation of notes of state banks5 or municipal corporations.6

For now, the I.R.S. has been treating Bitcoin (and other crypto) as though it were tangible property.  So we will be keeping a close ear to what we expect will be a very long (rambling?) speech today, we’ll be interested to see how the crypto advocate President navigates the Constitution on “money” – not that the Banksters haven’t already had their way with things, Federal Reserve Notes (with no convertibility_) and all.

Disappointingly, Richard Nixon – nominally a republican – was the one who slammed the convertibility window closed during his tenure in the Oval.

Meanwhile today, Tik-tok is back in business: TikTok restores service in US, thanking Trump. But there’s a 90-day clock ticking and tocking so we’ll see what happens by the end of April…

As the World Turns?

President Trump, on taking office, will be signing all kinds of Executive Orders on day 1. Over a hundred are expected by some counts, rolling back other last minute Biden affronts to democracy. Besides ordering mass deportation of illegals, Trump to Classify Cartels as Foreign Terrorist Organizations,  long overdue.

Meanwhile, the Snooze marches on – cold weather in the South heading our watch-list here. Where it’s 21F.

With odds rising that 2-3 inches of snow could land here overnight, the present storm system moving into the South is noting compared with what it dropped up north: Up to 12 inches of snow forecast for West Michigan by Tuesday.

Out in rhe Pacific, Australia is about to be slammed with a major weather event Tropical Cyclone off WA coast upgraded to category three system. (WA as in Western Australia, not Washington, the state…)

We will also be keeping our eyes open for major earthquake events in the next couple of months.  Has to do with celestial events… Seven planets are lining up in the sky next month. This is what it really means.  As planets align, gravity fields line up and…well, prep if you will…

At the Ranch: Cold Weather Cookery

Great pizza last night – and the reason was it made sense to capture all that oven heat .  So sure, baking is a good one when it’s cold.  We’ll be baking bread later on.

Also, because you can burn more calories, we might toss in some apple turnovers, as well.

We also like spicy food when it’s cold.  When the (sulfite-free) lime juice shows up, the chicken in a jerk sauce will start marinading. That will be tossed into the air fryer mid-afternoon.

Speaking of Marinading

We spent a half-hour yesterday debating whether those “vacuum meat tumblers” might be worth spending this month’s $160 monthly research budget on.  The theory is that marinades are more completely absorbed due to being under vacuum.  But the real reason for improved flavor has a lot to do with the tumbling of the meats which breaks down connective tissue.  If you have any experience with one of these newish kitchen tools, please share your response in the Comments below.

Ran into some odd ham radio antenna problems Sunday.  But, working on antennas is sub-freezing weather is not my favorite pastime. I’ll work on those problems in coming days. The other projects today include getting the hydroponics planted so we’ll have plenty of “starts” to put out when the (damn) cold weather ends and Spring shows up.

Something you can easily pencil out: Figure out how much you’re paying for “starts” for all your veggies at the big box store (if, like us, you don’t have patience to feed the birds starting from seed).  We use 18-plant site units (like this one) and it doesn’t take many seasons before hydroponics units pay for themselves.  Especially if you buy the hydroponic units during sale events… (look for sales at about $45-ish).

When you pencil out $3/plant for decent-sized plants, the hydroponics come close to break-even year one. Year 2 it’s all good.

  8. The weather has shut down any work on putting up the new hoop house here. Most of the weekend was spent moving hay to the timber patch where the cattle have taken up residence. We won;t be getting into doing any field work for a while and I estimate we have the hay to get through until summer. We exited our meager produce business when we moved and only kept a very few subscribers for our meat cattle.
    I would suggest that you find a local source for your garden plants besides the ones you can get from wally world or home depot. They typically get their stock trucked in from no telling where and they don’t always get the best care. I have a friend who has a large green house operation in eastern Kansas. He sets up small hoop units in grocery store parking lots over several counties and sells good quality plants direct to gardeners employing local folks. Good luck.

    I am pro vacuum sealing.. I have a vacuum marinator.. but rarely use it.. what I get a lot of use out of is the magic seal ms400 at three hundred but then I can and do retort canning I also have two chamber vac to..those are great if your going to do a hundred pounds of meat or vegitables.. pickles etc.
    if your serious about marinating they work great .. but if I was to buy a vacuum seal marina for then get the container and a magic seal ms400..you won’t regret it..

      Let’s look at a hypothetical scenario. A US bureaucrat defies a domestic ban on dangerous biotechnology experiments by personally farming it out to a contractor based in a hostile regime. Moving on with our completely made up hypothetical scenario, an outgoing brain-damaged executive gives an unconditional pardon to our physician of the great man-made disease.     ‘Problem is, Nelson Rockefeller resuscitated Nixon’s career.     • I would expand that. No person should maintain a clearance that doesn’t have a documented need. They can qualify up to a point in time, but should require an update once they’re accepted for a contractor job or employment. The clearance would be invalid until they’re actually on the job. They could advertise SC qualified as of XX date on their resume, but that’s it.

    Today’s Inaugural luncheon traditionally would be under the auspices of the outgoing First Couple. “CBS” reported that the dessert course was introduced by a Senator from Minnesota.

    The losing VP candidate state’s apples comprised an apple icebox terrine served with a sour cream ice cream and salted caramel. A high-content CO2 fizzy sparkling wine as dessert pairing represented the losing Presidential candidate’s state of California contribution. The winery was established in 1882 in the Russian River Valley adjacent to the Russian River. The region is namesake to the ethnic Russian assistant, Ivan Kuskov, to the first governor of the RAC (Russian American Company) whose southern outpost was Fort Ross (” ‘Russ”), Ca. His early 19th century home in Totmo (“Tomorrow”), Russia is now a museum. The Russian town’s flag is comprised of a running black fox while a sword impales an orb of Imperial authority.

    Well, one imagines toasts of “Good Luck!!” and other sundry pleasantries were exchanged by all in attendance.

      Folks,
      At 1:55 pm Tuesday afternoon Russian “Shot” published a report of a tragic Monday evening alleged attack at a Tel Aviv outdoor cafe by an alleged perp (of a surname translating to “judge”). A video collage captured moments during and after the engagement whose ending portrayed an alleged perp rendered immobile on the ground. Brooklyn, N.Y. based “The Jewish Times” published a report on Tuesday along with an image of the alleged perp’s US Green Card.

      At ‘israelnewspulse’ publicly posted on “X” the alleged perp’s now-deleted FB page. The outlet noted the individual had won a US Green Card in an annual lottery and been residing in Brooklyn.

      The allegedly Qatari government funded, London-stationed “Middle East Eye” appeared to have posted a report that the alleged perp had been neutralized by an off-duty policewoman. However I can’t find the link any longer.

      As a historical point of interest, the “Middle East Eye” publicly lists it’s office address which corresponds to the Grade 1 listed Sussex Place in Regent’s Park. The edifice was constructed in 1823 by the renowned Regency architect John Nash with financing provided by King George IV. The Sussex Place property is purposed as a learning institution having a twin campus in Dubai. Its motto is “to have a profound impact on the way the world does business”. The land upon which the building stands would appear to belong to either the Church of England or be a small piece of an estate granted to a noble family by King Henry VIII. The current day billionaire Viscount landowning lessor of noble English birth maintains a non-resident status for tax purposes. The Sussex Place school has a Dean originating from a Russian Caucasus republic. Prior to a disagreement with Mr. Putin the Dean had purportedly been an advisor to Russian President Medvedev. The school is a subsidiary to the UK’s third oldest university whose Chancellorship is held by the Princess Royal.
